The penalties for DWI (DUI) in New Jersey can be severe and can include substantial fines, driver’s license loss, alcohol and drug classes at the DMV, and jail time. These penalties are enhanced if you are not a first time offender and you have been charged and convicted of DWI in the past. The penalties can also be enhanced based on your level of intoxication.

Note: These penalties are updated based on the new law effective December 1, 2019
The first level of DWI punishment is for BAC levels of 0.08% to 0.10%. If your blood alcohol is in this range, you face:
- Fines of $250- $400
- Jail time of up to 30 days
- Loss of driver’s license until ignition interlock device installed
- Intoxicated Driver Resource Center for 12-48 hours
- Ignition Interlock device for 3 months
The next level of punishment exists for BAC levels above .10% but less then .15% during a first offense. For these you face:
- Fines of $300 to $500
- Jail time of up to 30 days
- Loss of driver’s license until interlock installed
- Intoxicated Driver Resource Center for 12-48 hours
- Mandatory Ignition Interlock device for 7 months to 1 year
The next level of punishment exists for all BAC levels above .15% for a first offense: For these you face:
- Fines of $300 to $500
- Jail time up to 30 days
- Driver’s license suspension of 4-6 months
- Intoxicated Driver Resource Center for 12-48 hours
- Mandatory Ignition Interlock device for 9 to 15 months
Second offense DWI Penalties in New Jersey
Again, if you’re being arrested for a second time, your BAC doesn’t matter. Anything over 0.08% and you’re facing the same punishment:
0.08% and above BAC:
- Fines of $500 to $1,000
- Jail time of up to 90 days
- Loss of driver’s license for one to two (2) years
- IDRC for 48 hours
- Community service for 30 days
- Mandatory interlock device for 2 to 4 years (in addition to period of license suspension).
Third Offense DWI Penalties in New Jersey
These are the penalties for a third DWI offense in NJ at a BAC level of 0.08% and above:
- Fines totaling $1,000
- Jail time for 180 days
- Loss of driver’s license for eight (8) years
- IDRC is determined on a case-by-case basis
- Mandatory interlock device for 2 to 4 years (in addition to the period of license suspension)
