Restraining Order Bergen County NJ – Bergen County Superior Court – Family Division
Here, we were hired to represent the client on both cases, the restraining order as well as the misdemeanor criminal charge. First, we appeared in the Superior Court, Family Division in Bergen County to handle the temporary restraining order (TRO) case. Luckily, the plaintiff, the client’s wife, decided that she did not want to proceed with the case and dropped the restraining order completely. She spoke to domestic violence counselors who explained to her the cycle of domestic violence to confirm that she was dropping the restraining order freely and voluntarily. Then, the Judge dismissed the case on the record in court after speaking to the plaintiff and confirming her wishes.
Edgewater Municipal Court – Domestic Violence Simple Assault Charges
Then, we appeared in Edgewater Municipal Court to fight the disorderly persons simple assault charge. The client’s wife appeared and spoke to the prosecutor and indicated her intention to have the charges dismissed. However, it is not completely up to her. The prosecutor, the police officer, and the Judge all must agree and dismiss the case. Without her cooperation and testimony, the prosecutor could not prove the charges against our client beyond a reasonable doubt. As a result, the Edgewater simple assault charges were dismissed. Then, we were able to file an immediate expungement to have the arrest removed from our client’s record as well.
