Travis J. Tormey and the Tormey Law Firm recently defended a client against first offense DWI charges in Guttenberg, New Jersey. The client was stopped by police in Guttenberg NJ and allegedly registered a blood alcohol concentration (BAC) of .13 percent. The client was subsequently charged with driving while intoxicated (DWI) and faced severe DWI penalties, including: suspension of his driver’s license for a period of 1 year, heavy fines, mandatory alcohol education classes at the Intoxicated Driver Resource Center (IDRC), and a sentence of up to 30 days in the county jail.
The client contacted the Tormey Law Firm, prompting Mr. Tormey to immediately get to work crafting a strong defense on behalf of the client. Mr. Tormey scrutinized the discovery evidence in the case and determined that the client’s breath test readings should be declared inadmissible by the municipal court judge. It was clear that the two breath samples provided by the client were “outside tolerance,” strongly suggesting that the breath machine may not have been functioning properly. In State v. Chun, the New Jersey Supreme Court’s ruled that these kinds of breath test readings in drunk driving cases were inadmissible. So the judge in this case tossed out the breath test evidence.
Additionally, Mr. Tormey argued before the Guttenberg Municipal Court judge that the client’s field sobriety tests should also be ruled inadmissible because they were possibly inaccurate. The client previously received a medical discharge from the armed services because of health issues with his foot. Mr. Tormey argued in court that the patrol officer should not have required the client to undergo field sobriety testing during the traffic stop because the client’s medical issues prevented him from successfully completing the field sobriety tests. Mr. Tormey also utilized the services of a DWI expert and retired NJ State Trooper who made the same declaration in court.
