Challenge the Field Sobriety Tests in my DUI Case
“Standardized Field Sobriety Tests are done to establish probable cause for a DWI arrest. But they must be done properly, with standard instructions, demonstrations by the police officer, and graded on a standardized scale. If not, they can be challenged in court.”
Part 6.
“Field Sobriety Tests”
There are many factors during the field sobriety test that can influence the officer’s decision to arrest you or not. Whether the test took place on a flat or rocky surface, in poor weather conditions, or at a time when you are sick, we can take these factors into account and work to beat these charges.
These are nationalized standard field sobriety tests. That means that the officer must follow the protocols regarding the instructions, demonstrating the tests properly, and grading the driver on a standardized scale. If he or she didn’t conduct these tests properly, demonstrate them, or graded them incorrectly, it can be a way to get your case dismissed completely.
Luckily, Christopher Perry, a partner at the Tormey Law Firm, is a certified field sobriety instructor from the police academy. He will review your evidence with his experience and specialized expertise to determine the possible defenses to your charges.
