Our client was charged with 3 disorderly person criminal charges including simple assault in violation of N.J.S.A. 2C:12-1(a), obstructing the administration of law in violation of N.J.S.A. 2C:29-1, and disorderly conduct in violation of N.J.S.A. 2c:33-2(a)(1). These three criminal offenses can result in substantial fines, jail time, probation, and a permanent criminal record. Our client was a young professional with no prior criminal history.
The charges arose out of Carlstadt in Bergen County. We appeared in court and negotiated a plea deal with the prosecutor. Our client was intoxicated and refused to leave the bar and got into a scuffle with the bouncer at the establishment. Then, because of his state of intoxication, he failed to completely comply with the instructions of the police officers who responded. Luckily, no one was injured and our client received the medical attention he needed at the hospital.
Based on his lack of criminal record, the fact that he was very apologetic and remorseful for the situation, and that no one was injured in the incident, the prosecutor agreed to dismiss two charges and the amend the third charge to a local ordinance (also known as a town ordinance, municipal ordinance, or borough ordinance). This results in a fine only and none of the other consequences. Most importantly, it keeps the client out of jail and preserves his clean criminal record.
