Travis J. Tormey of the Tormey Law Firm recently represented a client in the Bergen County Superior Court in Hackensack, NJ. The client was charged with possession of an illegal firearm, possession of a controlled dangerous substance (in this case, prescription drugs), and conspiracy. Our client was a resident of New Hampshire who had no prior criminal record.
First, our client’s parents hired us to get him out of jail. He was being held on a $100,000 bail with no ten percent option. The Tormey Law Firm filed a bail reduction motion and convinced the judge to lower bail to $65,000 with a ten percent option. This allowed his parents to post the 10 percent with the court, and he was released from jail.
Traveling Through NJ with a Gun in the Car – Arrested and Charged
The facts of the case were as follows: Our client and his girlfriend allegedly drove down from New Hampshire to New Jersey in order to trade a firearm for a number of prescription pills. This transaction was to occur at a rest stop on the Garden State Parkway, but the police intervened. Our client’s girlfriend was the mastermind of the conspiracy; our client was essentially just the driver of the vehicle. The co-defendant agreed to take responsibility for the firearm and for her role in the crime. As a result, she received a five-year state prison sentence, one year to be served without the possibility of parole. In exchange, our client received a two-year probationary sentence and only pleaded guilty to a fourth degree conspiracy charge.
