The first thing we will examine is the probable cause for the initial traffic stop. If the traffic stop was illegal or baseless, the entire DWI case should be dismissed based on a motion to suppress the illegally seized evidence. Also, can the State prove that you were actually operating the vehicle? If you were parked in a lot tailgating and there was no intent to operate the motor vehicle then this could be grounds to dismiss the DWI charge.
Moreover, we will examine the field sobriety tests they had you conduct at the scene. One of our attorneys, Christopher Perry, is a certified field sobriety instructor and he will examine the instructions, the officer’s demonstrating the tests to you, and the grading of those tests to see if they were conducted properly. Finally, Mr. Tormey himself is certified on the Alcotest 7110 breath testing device in NJ. He will look at the machine itself including calibration records, solution change reports, and any repair issues the machine may have had in the past. He will also examine the process to confirm that the police officer’s watched you for the mandatory 20 minute period before taking your breath samples, that all portable electronic devices were removed from the room prior to the taking of your breath samples, and that a new mouthpiece was utilized for each sample that was collected. If there are issues with any of these processes, then the breath test reading itself can be attacked and may be suppressed by the Judge in court.
If you have a refusal to submit to a breath test charge, we will also examine the probable cause for the stop, your field sobriety tests, and whether or not the refusal charge can be prosecuted by the State. They must read you a standard statement form in a language you understand and they must read both parts of the form if you do not agree to take the breath tests.
