What Happens if Convicted of DUI in East Rutherford?
Getting a DWI, even for the first time, is serious business in New Jersey. The law requires that anyone caught driving under the influence of alcohol must install an ignition interlock device, which acts like a breathalyzer and prevents a car from starting if a driver has a BAC reading of 0.05% or higher. If they blow a 0.08% to 0.10% BAC, they keep the device in their car for 3 months, and 7 to 12 months for registering 0.10% to 0.15%. However, a first- time offender’s license is not generally suspended if their BAC is between 0.8 and 0.15, only until they install the interlock device. If they blow over 0.15, they lose their license for 4 to 6 months and must drive with the interlock device for 9 to 15 months after that.
Tougher still, a second DUI offense means your driver’s license is suspended for 1 to 2 years, and you must drive with an ignition interlock for 2 to 4 years. Three or more DUI or DWI offenses result in an 8 year period of license suspension and an interlock device for 2 to 4 years. Refusing to take a breath test is also an offense with specific penalties. If you are convicted for refusing to submit to a breath test, your license is suspended until you install an ignition interlock device, which you must drive with for 9 to 15 months (this is for a first refusal, after which the penalties get worse). And a person convicted of driving under the influence of drugs (narcotics, hallucinogens, and addictive drugs) loses their license for 7 to 12 months but does not have to install an interlock device. Otherwise, the penalties are the same as those for driving under the influence of alcohol convictions.
However, license suspension and driving with an interlock device are not the only penalties for a DWI in East Rutherford. If convicted for your first offense, you pay between $250.00 and $500.00 in fines, and pay higher insurance premiums, along with a three-year $1,000.00 annual surcharge. You also spend 48 hours in a two-day Intoxicated Driver Resource Center and up to 30 days in jail. For a second offense, the fine increases to $1,000.00 and the jail term extends to a potential 90 days plus 30 days of community service. A third offense enlarges the incarceration period to potentially six months and the insurance surcharge to $1,500.00 per year for three years. And these fines do not even include the fees you pay for installing and maintaining the interlock device, which is costly. What’s more, a conviction in East Rutherford Municipal Court results in a DWI on your driving record with the Division of Motor Vehicles.
