“Skilled DWI Lawyer Fights Drunk Driving Charges throughout New Jersey.”
Travis J. Tormey and the Tormey Law Firm recently defended a client who had been charged with driving under the influence of drugs (DUI) in Clifton, NJ. The client was also charged with a disorderly persons offense, and faced criminal penalties, for being under the influence of drugs. The consequences were serious: a conviction would have resulted in the client losing her driver’s license for one year and being sentenced to six months in Passaic County Jail. Moreover, the client would have been left with a criminal conviction on her permanent record.
The potential legal nightmare began for the client when she was pulled over by a patrol officer for making an illegal U-turn. After being stopped, the client allegedly failed field sobriety tests that were performed at the scene. At that point, she was placed under arrest and charged with a DUI. A short time later, Clifton police administered a breath test: the client blew .00 percent BAC on the Alcotest machine, indicating that there was no evidence of alcohol in her system. Clifton NJ police officers suspected that the client was under the influence of drugs, so they took a urine sample. However, police failed to use a drug recognition expert (DRE) to examine the client. Importantly, the DRE is supposed to determine whether a DUI suspect was actually under the influence of drugs at the time they operated the motor vehicle.
When the client’s lab results came back, they showed that the client tested positive for allergy medicine and cough syrup. Since law enforcement had failed to provide a DRE evaluation, they could not prove that the client was under the influence of marijuana or any other illegal drugs when she was behind the wheel. As a result, Travis Tormey was able to get the DUI charges dismissed. Beyond that, Mr. Tormey got the prosecution to dismiss the criminal charges as well. This was a great result for our client and a major victory for the Tormey Law Firm.
