The client did not have a prior criminal record, but he was still subject to severe penalties if convicted on these charges. The charges could have caused significant problems for the client’s career because he was employed in the Newark school system. While the criminal charges remained pending, he was suspended from his job. Accused of Marijuana Distribution in Essex County, New Jersey
The first criminal charge against our client was marijuana distribution. The client left work during his lunch break and visited his friend at a Newark bodega. Around the same time, Newark NJ detectives were in the middle of conducting an investigation into possible drug activity at the store. When police officers raided the store and found a large amount of marijuana, our client was present. Even though our client had done nothing wrong, he was arrested and charged with a felony-level offense for possession of marijuana with intent to distribute.
The good news for the client was that he had the Tormey Law Firm on his side throughout the drug crime case. Travis J. Tormey talked to witnesses and highlighted crucial evidence that exonerated our client of the criminal charges. Eventually, another person who was present at the bodega took responsibility for the marijuana and pleaded guilty to drug distribution charges. Our client was exonerated, so Essex County prosecutors agreed to drop the criminal charges against him.
Charged with Endangering the Welfare of a Child in Newark, NJ
The next criminal charge against our client was endangering the welfare of a child. The basis for this very serious charge was an allegation that he bruised the eye of a young child. The child was his girlfriend’s son. There were no witnesses to the alleged incident, so no one could really say for sure what caused the child’s injury. It was possible that he sustained the injury by accidentally bumping his head, as children are known to do sometimes. Additionally, the client’s girlfriend, the mother of the injured boy, did not even accuse the client of causing her son’s injury; the accusation came from the child’s grandmother, who was not present at any point while the client interacted with the child.
Since the client was dating the mother of the boy at the time of the injury, prosecutors could potentially have questioned the mother’s credibility. However, she had a high degree of credibility when saying that the client did not cause the injury because she and the client were no longer dating. This meant that she had no reason to lie on the client’s behalf.
Travis J. Tormey raised all of these points when arguing for a dismissal of the charges. Ultimately, Mr. Tormey was successful in getting the child endangerment charges dismissed because the State lacked evidence and could not prove the case beyond a reasonable doubt.
