Travis J. Tormey and Christopher Perry, both with the Tormey Law Firm LLC, recently argued on behalf of a client who faced charges for marijuana possession (less than 50 grams) and possession of illegal fireworks in Mount Olive, NJ. The charges were considered to be disorderly persons offenses (misdemeanors), which meant that the case had to be adjudicated in the Mount Olive Municipal Court.

The charges stemmed from an arrest that was made more than 25 years earlier, way back in 1990 when our client was only a young man. He and his friends were allegedly found in possession of a small amount of marijuana and some illegal fireworks, resulting in their arrests. Our client was not able to resolve these minor criminal charges because he moved from NJ to California. He went on to become a successful business man and a fine family man, but the pending charges in New Jersey always lingered. One of the consequences of the charges was that our client was unable to get a firearms license when he applied for one in California. That’s when he decided to call the Tormey Law Firm and get an aggressive criminal defense team on the case.

Mr. Perry immediately filed a motion to dismiss the charges because it had been so long since the charges were filed in the first place. Mr. Perry also made sure that the court was aware of the fact that the client’s permanent record was clear of any criminal charges or convictions, with the exception of the pending drug offense charges. The State did not have a lot of evidence to support their case, so the charges were dropped.
