Marijuana Charges Dismissed in Paramus NJ Thanks to the Tormey Law Firm
The Tormey Law Firm recently defended a client against charges for possession of marijuana under 50 grams and possession of drug paraphernalia.
Our client was an out-of-state resident who hailed from Chicago. He had been stopped by a New Jersey state trooper while driving his vehicle on the Garden State Parkway earlier this year.
When the client contacted the Tormey Law Firm, we immediately got to work defending him against the charges. Travis J. Tormey, the firm’s founding partner, entered an appearance in court and requested discovery evidence from the prosecutor. “Discovery” evidence refers to police reports, lab reports, video evidence, and any other evidence that the prosecution possesses and plans to use during trial.
Since this case involved the New Jersey State Police, the prosecutor had to request discovery directly from the State Police in Trenton, NJ. Unfortunately, the prosecution delayed for five months and never was able to obtain discovery from the State Police. This delay went on for five months and several court appearances.
Throughout the entire process, Mr. Tormey continued to assert his client’s right to a speedy trial. Mr. Tormey asked the judge to dismiss the charges because of the prosecution’s failure to provide discovery.
On the day of the trial, the arresting officer appeared in court and the prosecution was set to try the case. However, the prosecution had still failed to provide us with the necessary discovery evidence. So, once again, Mr. Tormey filed a motion to dismiss the charges due to the prosecution’s failure to provide discovery. On this occasion, the judge granted the motion to dismiss.
It is important to note that the charges against our client were disorderly persons offenses. This means that our client faced significant punishments, which included up to 6 months in the county jail, a $1,000 fine, and a criminal charge on his permanent record. However, as a result of Mr. Tormey securing a dismissal of all charges, our client was able to avoid any penalties.
The client was ecstatic about this outcome. This was a tremendous result for the Tormey Law Firm.
