Possession of a Destructive Device 2C:39-3a– This charge applies to grenades, explosives, and other “destructive” devices.

Unlawful Possession of a Weapon Charge NJ – 2C:39-4 – This charge applies to any item that can be used as a “weapon” even if it’s a piece of debris from the street.

Unlawful Possession of a Machine Gun – N.J.S. 2C:39-5(a) – Automatic weapons that can be defined as machine guns are prosecuted under this statute.

Unlawful Possession of a Hand Gun – N.J.S. 2C:39-5(b) – Handguns and even some BB or airsoft guns are prosecuted under this statute.

Unlawful Possession of Rifles and Shotguns – N.J.S. 2C:39-5(c) – The NJ Gun Law as it applies to Rifles and Shotguns.

Unlawful Possession of Other Weapons – N.J.S. 2C:39-5(d) – Other weapons which may or may not be firearms can sometimes be prosecuted under this statute.

Unlawful Possession of Assault Firearms – N.J.S. 2C:39-5(f) – “Assault” firearms in NJ might not be legal, depending on how they are stored and their specific firing capabilities.

Certain Persons To Not Have Weapons 2C:39-7 – This charge refers to people who have been caught with weapons but are not supposed to possess them (i.e. those with a criminal record or certain mental disabilities).
