The defendant was ultimately charged with assault by auto, reckless driving, careless driving, failure to maintain a lane, and driving an uninsured vehicle. For additional information, please see the NJ.com article entitled, “Drunk driver injures two in Budd Lake crash, cops say”.
It doesn’t appear from the article that the driver was charged with drunk driving (DWI). This means that the driver’s blood alcohol content (known as “BAC”) was below the legal limit of .08%. However, being under the influence of any alcohol and getting into an accident can justify a charge of reckless driving and assault by auto. It depends on the other details of the crash and the circumstances surrounding the accident.
Assault by auto is a criminal charge in New Jersey that will be graded as a third degree, fourth degree, or disorderly persons (misdemeanor) charge depending on the circumstances of the alleged offense. A third degree crime is punishable by 3-5 years in prison, a fourth degree crime is punishable by up to 18 months in prison, and a disorderly persons offense is punishable by up to 6 months in the county jail.
