Aggravated Assault on Police Officer Charges in Paramus NJ

According to NJ.com, a Georgia resident ran from a traffic stop and fought with local police in Paramus on Sunday. The 24-year-old man was stopped by Paramus police at 1 a.m. When he was stopped by the police officer, he allegedly poured a liquid (believed to be alcohol) out on the street. The defendant denied pouring anything out and told police he didn’t have any identification.

The defendant then took off on foot and was chased by several officers. When they caught up with him he fought with several officers before being handcuffed and arrested. Police later determined that the defendant had a “no-bail” warrant out of Passiac County for a violation of probation. He was charged with aggravated assault on a police officer, resisting arrest, and hindering apprehension.

Aggravated assault on a police officer is governed by N.J.S.A. 2C:12-1(5)(a) which provides in pertinent part:

§ 2C:12-1. Assault

A person is guilty of aggravated assault if he:
(5) Commits a simple assault as defined in subsection a. (1), (2) or (3) of this section upon:
(a) Any law enforcement officer acting in the performance of his duties…

Paramus Assaulting a Police Officer, Resisting Arrest Charges

The defendant is facing multiple felony charges based on this incident including aggravated assault on a police officer, resisting arrest, and hindering apprehension. He was also on probation in Passaic County for felony charges which will be considered an aggravating factor for sentencing based on the fact that he already has a felony record and that he failed to comply with probationary treatment that he previously received.
