Meaning of Sexual Assault under New Jersey Law

Sexual assault is a crime of the second degree. While it carries less of a mandatory minimum sentence compared to aggravated sexual assault, if convicted, a defendant will still sustain significant prison time and penalties.  Under N.J.S.A. 2C:14-2,

  1. An actor is guilty of sexual assault if the actor commits an act of sexual contact with a victim who is less than 13 years old and the actor is at least four years older than the victim, or
  2. An actor is guilty of sexual assault if the actor commits an act of sexual penetration with another person under any one of the following circumstances:

(1) The actor commits the act using coercion or without the victim’s affirmative and freely-given permission, but the victim does not sustain severe personal injury;

(2) The victim is on probation or parole, or is detained in a hospital, prison or other institution and the actor has supervisory or disciplinary power over the victim by virtue of the actor’s legal, professional or occupational status;

(3) The victim is at least 16 but less than 18 years old and:

(a) The actor is related to the victim by blood or affinity to the third degree; or

(b) The actor has supervisory or disciplinary power of any nature or in any capacity over the victim; or

(c) The actor is a resource family parent, a guardian, or stands in loco parentis within the household;

(4) The victim is at least 13 but less than 16 years old and the actor is at least four years older than the victim;

(5) The victim is a pupil at least 18 but less than 22 years old and has not received a high school diploma and the actor is a teaching staff member or substitute teacher, school bus driver, other school employee, contracted service provider, or volunteer and the actor has supervisory or disciplinary power of any nature or in any capacity over the victim.

Additionally, sexual assault, or rape, is defined in part under N.J.S.A. 2C: 14-1, which refers to the sexual penetration of a victim.  The terms “rape” and sexual assault are used interchangeably in the State of New Jersey; however, in other States rape and sexual assault may be viewed as different crime.

How do they prove sexual assault in NJ?

Pursuant to N.J.S.A. 2C:14-5, a prosecutor is not be required to offer proof that the victim resisted, or reasonably resisted the sexual assault in any offense.  In addition, no actor shall be presumed to be incapable of committing a crime because of age, impotency or marriage to the victim, and it is not a defense for an actor to believe the victim is above the age stated for the offense, even if such a mistaken belief was reasonable.

What is the Punishment for Sexual Assault in New Jersey?

Sexual assault is a second degree crime in New Jersey. This charge carries a prison sentence of 5 to 10 years in addition to a maximum fine of $150,000. If convicted, not only does a defendant face serious prison time, but after he or she completes the sentence, there is a strong likelihood that one will have to report for Megan’s Law Registration and possibly be labeled as a sex offender for life.  Convictions for sexual assault are presumptively indictable crimes, which means there is a mandatory period of incarceration for convictions for crimes related to sexual assault.
