We recently were retained by a client to handle a DWI for him which occurred in August 1993 in Mount Arlington NJ in Morris County. The client failed to appear in court and moved to Florida and never resolved the outstanding tickets. As a result, a warrant was issued for his arrest. This was causing him issues in Florida now regarding his driver’s license and he wanted to try and clear these tickets up if possible.
We appeared in court after receiving the discovery package from the State. Discovery is all the evidence the State possesses and intends to rely upon in court to try and prove the case against the defendant. On a DWI case, this typically includes police reports, videos, accident reports (if applicable), and all the documents relating to the breath testing machine. Because this case was from 1993, the old breathalyzer machine was used. In addition, the police officer who arrested our client is now retired and is no longer on the police force. In these cases, the officers very rarely have any knowledge of the arrest and can’t remember the specifics (even after reviewing their reports). As a result, it is very difficult for the State to prove the case beyond a reasonable doubt.
After several court appearances, the State could not prove the charges after all this time and the DWI was completely dismissed against our client. Now, he can get his license in Florida without any issues and the warrant for his arrest has been removed.
